Agreement to Terms

By accessing or using the Cowford Design Services LLC website or engaging our services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our website or use our services.

Services

Cowford Design Services LLC provides design services including, but not limited to, brand identity design, website design and development, UI/UX design, print design, and ongoing design support. Specific terms for each project will be outlined in individual proposals and contracts.

Intellectual Property

Unless otherwise agreed in writing:

• All intellectual property rights in work created by us remain ours until full payment is received.
• Upon full payment, intellectual property rights for final deliverables transfer to the client as specified in the project agreement.
• We retain the right to display work in our portfolio and promotional materials unless otherwise agreed.
• Preliminary concepts and unused work remain our property.

Payment Terms

Payment terms are specified in individual project proposals. Generally:

• A deposit is required before work begins
• Payment schedules for larger projects will be outlined in the proposal
• Late payments may incur interest charges and work may be paused until payment is received

Client Responsibilities

Clients agree to:

• Provide timely feedback, content, and approvals as needed
• Ensure all materials provided to us do not infringe on third-party rights
• Pay invoices according to agreed terms
• Communicate clearly and respond to requests within reasonable timeframes

Revisions and Changes

Project proposals include a specified number of revision rounds. Additional revisions or changes to project scope may result in additional charges and timeline adjustments. Any scope changes will be discussed and agreed upon in writing before proceeding.

Limitation of Liability

To the maximum extent permitted by law, Cowford Design Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability shall not exceed the amount paid for the specific services giving rise to the claim.

Termination

Either party may terminate a project in accordance with the terms specified in the project agreement. Termination terms, including any kill fees or payment for work completed, will be outlined in individual contracts.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
